These terms apply to the SoundQuest app ("the app") made by JC Goodworks ("we", "us"). By installing or using the app, you agree to them. If you use the app for a school or clinic, you agree on its behalf and confirm that you are allowed to do so.
Your licence
We give you a personal, non-transferable licence to use the app on devices you own or control, under these terms and the rules of the store you got it from. School and clinic licences cover the number of seats or sites bought. You may not copy, resell, reverse-engineer or redistribute the app or its content, except where the law allows it.
How the app is meant to be used
- SoundQuest is a practice and progress-monitoring tool for use with a qualified speech-language pathologist (SLP). It does not diagnose, treat or cure any condition and is not a medical device.
- Its feedback is automated and can be wrong. The SLP decides on targets, plans and progress, and can override the app at any time.
- Children should use the app under the supervision of an SLP, teacher or parent.
Your data
Student data stays on your device and belongs to you, or to your school or clinic. You are responsible for getting any consent your school, clinic or local law requires before you enter a student, and for keeping the device secure. Our Privacy Policy explains how the app handles data.
Purchases
Purchases are made through the App Store, Google Play or a school or clinic licence agreement, and that channel's payment and refund terms apply.
Content
The words, pictures, games and sounds in SoundQuest are original and belong to us or our licensors. They are not taken from any standardized test.
No warranty
To the extent the law allows, the app is provided "as is", without warranties of any kind. We do not promise that it will be error-free or that it will produce any particular result for any child.
Limit of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data, and our total liability is limited to what you paid for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Apple devices
If you got the app from the App Store, these terms are between you and JC Goodworks only, not Apple. Apple is not responsible for the app or its content, has no duty to provide maintenance or support, and is a third-party beneficiary of these terms with the right to enforce them. Apple's standard licensed application end user licence agreement also applies.
Governing law
These terms are governed by the laws of the State of North Carolina, USA, unless the law where you live says otherwise.
